1. Who we are
Top Performer LLC, a Florida limited liability company, doing business as you vs., Jacksonville, Florida ("we"). Contact: michael@topperformer.ai. We are the seller on your receipt and the data controller described in our Privacy Policy.
2. Eligibility
You must be 18 or older. We don't collect birth dates; you confirm your age when you sign up or pay. The service is not directed to children. If we learn a user is under 13, we delete the account.
3. Beta access and purchases
The free beta gives you 30 days (720 hours) of access to currently available SIE and Series 7 training. Your window starts only when you tap “Start my 30 days,” once per account. No payment card is required. Beta access does not renew, charge you, or automatically become a paid membership. See your end date in Account.
Content and features are still expanding. This is a companion to your study materials, not a claim of complete curriculum coverage. We may close new enrollment without shortening existing beta windows. Your saved progress stays on the same account after beta ends and when you upgrade, unless you delete your account. Any future paid offer requires a separate purchase decision.
Existing one-time 90-day purchases keep the access terms shown at purchase. Access is personal and non-transferable; one person per account, with no account sharing. The free beta does not change an existing paid access period.
4. Independent product
you vs. is an independent study product. It sells 90 days of access to original practice drills built from the public content outlines that exam sponsors publish. It is not affiliated with or endorsed by FINRA. It does not use or ask for real exam questions. It gives no investment, tax or legal advice. It does not promise that anyone will pass.
Educational exam-prep content only. Not investment, tax or legal advice.
5. Exam integrity
You agree not to post, upload or share real exam content through the service, and to follow your exam sponsor's candidate rules (see FINRA's Rules of Conduct). We may remove content and close accounts that break this.
6. Our content
Questions, explanations and drills are ours. No scraping, copying, resale, or use to train AI models.
7. The Promise
For eligible paid passes: Don't pass? Show us your attempt and we'll extend your access to your next test date plus 30 days, free. Beta access does not itself include a paid-pass promise claim. The full offer terms are on the Promise terms page and form part of these terms.
8. Refunds
You can ask for a full refund of a web purchase within 7 days of buying it, once per customer, by emailing michael@topperformer.ai from your account address. A refund ends that pass. App Store purchases are refunded by Apple through its "Report a Problem" page, under Apple's rules.
9. Readiness and scores
Readiness, scored rounds and streaks are study signals from your practice. They are not predictions of exam results.
10. Accuracy
We work hard to be correct and current, but rules change. Tell us about errors at michael@topperformer.ai. The service does not replace your exam sponsor's official materials.
11. Disclaimers and limits of liability
The service is provided "as is". To the extent the law allows, our total liability to you is limited to what you paid us in the 12 months before the claim.
12. Governing law
Florida law governs these terms. Disputes go to the state or federal courts in Duval County, Florida, except that either of us may use small-claims court.
13. Changes, termination, contact
If we change these terms in a material way, we will tell you and ask you to accept the new version the next time you sign in. You can stop using the service and delete your account at any time. We may suspend accounts that break these terms. Contact: michael@topperformer.ai.
